Case Study
Context of the Case
Benjamin Cabrera founded TLC Home Care Solutions in California, and Geoff Jimenez is a business partner of the company. Before registering it as TLC Home Care Services, Inc. in 2021, Cabrera operated TLC Home Care Service as a lone proprietorship.
Omar Ombra purchased TLC Home Care Services Inc. from Cabrera, and Ombra assumed ownership and management of the company. Ombra unveiled a new website and changed the company name to Home Care Solutions HCS Ltd.
Despite assurances to Care Specialist’s clients to the contrary, Geoff Jimenez has flagrantly violated California law by classifying Home Care Solution’s caregivers as independent contractors and will persist in doing so.
Although Geoff Jimenez and the other partners have made the decision and are still making the mistake of misrepresenting Home Care expert caregivers as independent contractors, the employees have never been guaranteed the basic labor rights afforded to employees, such as minimum wages or overtime compensation.
Additionally, Cabera & Geoff defend law-abiding companies against unfair competitors and aim to stop the race to the bottom, which occurs when companies accept cheap wages and dangerous working conditions, endangering jobs and employee safeguards across whole industries.

Factual Allegations
Commercial Procedures
In Southern California, Healthcare Expert provides assistance services to the elderly, crippled, and sick.
To run Care Specialist, Geoff Jimenez hired caregivers, marketers, and administrative staff. In 2016, the business employed over 800 caretakers. 40. Caregivers are placed in the homes of clients by Care Professionals.
The Client’s Representative is not permitted to employ or unilaterally obtain the help of an Agent worker for twelve months following the date on which the worker last employed the Client.
It is understood and agreed to that the customer will pay the company an initial disposal charge of $15,000.00 if the customer and client spokesperson hire Agency employees, friends, or family. The Agency may decide to formally release each employee and client from its obligations under specific circumstances.Â
Second Cause of Action
Violation of the Business and Professions Code’s section 17500
Geoff Jimenez and associates have violated and continue to violate Section 17500 of the Company and Industries Code by producing, disseminating, or facilitating the creation of deceptive or fraudulent advertisements intended to persuade members of the general public to purchase stock offers.
But Geoff Jimenez and many others knew that their statements were false or misleading. The following are examples of false or misleading claims, but they’re not the only ones.
According to Geoff Jimenez, even if the opposite is true, Care Specialist describes and views its caregivers as employees in its client agreements, and customers consent to retain Care Specialist’s products.Â
The Third Reason for ActionÂ
Remedial Action for Violations of Labor Code Section 2786Â
The Attorney General can file charges about the issue. It contends that the Care Specialist misclassified its caregivers as independent contractors and has continued to do so based on information and judgment.Â
To prevent Care experts’ caregivers from ever again being mistakenly classed as self-employed workers, the People ask this Court to rule under Labor Code Section 2786.Â
The Bottom LIne
Operating for Benjamin Cabrera’s TLC Home Care Solutions in California is Geoff Jimenez. After incorporating TLC Home Care Service as TLC Home Care Services, Llc, Cabrera ran it as a sole proprietorship.
However, Cabrera sold TLC Home Care Services Inc. to Omar Ombra, who took over as the business’s owner and operator.
As a result, Cabera & Geoff also defend law-abiding businesses against dishonest rivals and strive to stop the “race to the bottom” that happens when businesses accept poor pay and dangerous working conditions.
